FisketipsNorge – Terms of Use / End User License Agreement (EULA)

These Terms of Use / End User License Agreement (“Terms”) govern your use of the FisketipsNorge application and related services (collectively, the “App”), provided by Drift Studio (“we”, “us”, “our”). By downloading, installing or using the App, you agree to be bound by these Terms.

This agreement is between you and Drift Studio, not with Apple Inc. (“Apple”). However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

1. Eligibility & account

1. Age. You must be at least 13 years old (or the minimum age in your country that allows you to consent to digital services) to use the App. Users under 18 must have permission from a parent or legal guardian.
2. Account. Certain features (for example: saving spots, social feed, Fisketips+ premium features) require an account. You are responsible for keeping your login details secure and for all activity under your account.

2. License grant & rights

1. Limited license. Subject to your compliance with these Terms, Drift Studio grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service.
2. Restrictions. You may not:
   • copy, modify, reverse engineer, decompile or attempt to extract the source code of the App, except where this is allowed by law;
   • rent, lease, lend, sell, redistribute or sublicense the App;
   • circumvent or attempt to circumvent any security or technical protections in the App;
   • use the App in any way that is unlawful, harmful, abusive, harassing, or otherwise objectionable.
3. Apple-Device terms. Your use of the App must comply with the Apple Media Services Terms and Conditions and the App Store Review Guidelines as applicable.

3. In-app purchases & Fisketips+ subscription

1. In-app purchases. The App may offer extra features through one-time purchases or subscriptions (for example Fisketips+). Prices are shown in your local currency in the App Store and may change from time to time.
2. Billing & payment. All payments are processed by Apple through your Apple ID. We do not collect or store your payment details. Your purchase is subject to Apple’s terms and conditions, including their refund policies.
3. Subscriptions. If you subscribe to Fisketips+:
   • The subscription will automatically renew for the same period and price unless you cancel at least 24 hours before the current period ends.
   • Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
   • You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions on your device.
   • If a free trial is offered, any unused portion is forfeited when you start a paid subscription.
4. Changes. We may change or discontinue subscription features. If we significantly change the service or price, we will attempt to notify you in the App or via the App Store listing.

4. User content & community rules

1. Your content. The App may allow you to upload or share content, such as photos, catch logs, text, locations, comments and other material (“User Content”). You retain ownership of your User Content.
2. License to us. By uploading or sharing User Content in the App, you grant Drift Studio a worldwide, non-exclusive, royalty-free license to store, use, display, modify and distribute your User Content within the App for the purpose of operating, improving and promoting the service. You can delete your content in the App; this may not remove prior backups or content that others have already saved or shared.
3. Responsibility. You are solely responsible for your User Content and for ensuring that you have all necessary rights to upload it. You agree not to upload content that:
   • is illegal, abusive, harassing, hateful, threatening, or discriminatory;
   • contains nudity, sexual content, excessive violence or shocking material;
   • infringes copyrights, trademarks, privacy or other rights of third parties;
   • contains personal data about others without their consent;
   • is spam or unauthorized advertising.
4. Moderation & reporting. We may remove or hide content, and suspend or terminate accounts that violate these rules or that we reasonably believe may harm other users, Drift Studio or third parties. The App may contain a report function so users can notify us about problematic content. We do not actively monitor all content in real time.

5. Fishing, safety & responsibility

1. No guarantee of catch. The App gives information, tools and tips (for example: fishing spots, weather, tide, “Good conditions” scores). This information is for guidance only and does not guarantee catches or specific results.
2. Safety. You are always responsible for your own safety and the safety of others when fishing, travelling or being near water. Always use appropriate safety equipment (for example life jackets) and follow local advice regarding weather, waves, ice and currents.
3. Regulations. You must obey all local laws and regulations for fishing, including seasons, protected species, size limits, quotas, gear restrictions and access rights. The App may sometimes show general information, but it is your responsibility to check official sources.

6. Weather, tide, maps & location data

1. Information sources. Weather forecasts, tide information, water levels and other environmental data may be retrieved from external providers (for example national meteorological services or hydrological APIs). Data may be delayed, incorrect or unavailable.
2. No warranty. We do not guarantee the accuracy or completeness of any weather, tide, map or condition information. Always use your own judgement and consult official forecasts.
3. Location services. Some features rely on your device’s GPS/location. You can turn this off in your device settings, but some features may then not work. By enabling location, you consent to the App using this data to show your position, nearby spots and similar functions, as described in our Privacy Policy.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and process personal data. The Privacy Policy is available on our website and in the App. By using the App, you agree to the Privacy Policy.

8. Intellectual property

1. The App, including all code, design, text, graphics, logos, icons and other content (excluding User Content), is owned by Drift Studio or its licensors and is protected by copyright and other intellectual property laws.
2. “FisketipsNorge” and “Drift Studio” are trademarks or trade names of Drift Studio. You may not use these without our prior written permission.

9. Termination

1. You may stop using the App at any time and can uninstall it from your device.
2. We may suspend or terminate your access to the App, or parts of it, if you:
   • breach these Terms or our community guidelines;
   • misuse the App or attempt to interfere with its operation; or
   • use the App in a way that may cause harm to us, other users or third parties.
3. Upon termination, your license to use the App ends. Some provisions of these Terms (for example: intellectual property, disclaimers, limitations of liability and governing law) will continue to apply.

10. Disclaimer of warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, availability or non-infringement.

We do not warrant that the App will be error-free, secure, or available at all times, or that defects will be corrected. Use of the App is at your own risk.

11. Limitation of liability

1. To the maximum extent permitted by law, Drift Studio and its owners, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the App.
2. Our total aggregate liability for any claim related to the App or these Terms shall not exceed the amount you have paid for the App or in-app purchases in the last twelve (12) months (excluding amounts paid to Apple as platform fees), or the minimum amount required by applicable law.
3. Some jurisdictions do not allow limitations of certain liabilities, so some of the above limitations may not apply to you.

12. Changes to the App and these Terms

1. We may update or change the App, including adding or removing features, improving performance, or correcting issues.
2. We may also update these Terms from time to time. Updated Terms will be available in the App or on our website, with a new “Last updated” date. If you continue to use the App after the Terms have changed, you are deemed to have accepted the updated Terms.

13. Governing law & disputes

1. These Terms are governed by the laws of Norway, without regard to its conflict of laws rules.
2. Any disputes shall be subject to the jurisdiction of the courts of Norway, unless mandatory law gives you the right to bring claims in your home country.

• Du er selv ansvarlig for brukernavn, passord og aktivitet på kontoen din.

4. Fisketips+, kjøp og abonnement

• Betaling skjer via Apple-kontoen din. Vi lagrer ikke kortinformasjon.
• Abonnement fornyes automatisk hvis du ikke sier opp minst 24 timer før perioden utløper.
• Abonnement administreres i Innstillinger → Apple-ID → Abonnementer.

5. Innhold du laster opp

• Du eier selv bilder, tekst og annet du legger inn, men gir oss en lisens til å vise og lagre det i appen.
• Du må ha rett til innholdet og ikke bryte loven, opphavsrett, personvern eller våre retningslinjer.
• Vi kan fjerne innhold og sperre konto ved misbruk (hat, trusler, nakenhet, vold, spam osv.).

6. Sikkerhet, vær og regler

• Appen gir tips, ikke garantier. Du er alltid selv ansvarlig for sikkerhet på sjøen, ved elver og vann.
• Du må selv sjekke offisielle fiskeregler, fredningstider, kvoter og lokale bestemmelser.
• Vær-, tidevanns- og vannstandsdata kan være unøyaktige eller utilgjengelige.

7. Ansvarsfraskrivelse (kort)

• Appen leveres “som den er”, uten garanti for at alt er korrekt eller tilgjengelig hele tiden.
• Drift Studio er ikke ansvarlig for indirekte tap, tapt fangst, skader eller følger av at du bruker appen.

8. Endringer

Vi kan oppdatere appen og disse vilkårene. Fortsatt bruk etter endring betyr at du aksepterer de nye vilkårene.
